Lira, Uganda | THE INDEPENDENT | The High Court sitting in Lira has rejected the bail application of Lt. Col. Nelson Ayebare, who is battling murder charges. Ayebare is accused together with several other soldiers of killing Remijo Okello, a resident of Oyam district at Lira Garrison in April this year.
The others are Pt. Emmanuel Ogete, Corporal Basaja Balaba Fred, Morris Oruk, Jimmy Okello and Boniface Ogwang. It is alleged that the suspects killed Remijo Okello, an ex-soldier when they went to recover a gun from him at Wigweng village, Iceme sub-county in Oyam district.
The suspects reportedly shot the deceased to death before arresting his 9 family members. They were arrested and charged with murder contrary to section 188/189 of the Penal Code Act, and conspiracy to commit murder contrary to section 188 and 189 of the Penal Code Act.
Ayebare and Basaja who led the operation were slapped with an additional charge of negligence of duty. On Wednesday, Ayebare applied for bail through his lawyers of Ponsiano Okello on grounds of ill health to enable him to access better treatment outside prison.
However, the visiting Lira High Court Judge Vincent Emmy Mugabo turned down the bail application saying Ayebare might not return to court once released on bail.
“Having looked at the role and the submissions made by both parties, I am not convinced that the applicant may return to court for trail……for that reason the application is not allowed,” he ruled.
