Kampala, Uganda | THE INDEPENDENT | Justice Tadeo Asiimwe has summoned Mercy Nakibuka, the Secretary of Mpererwe Sekanyonyi Zone Mpererwe in Kampala District.
Justice Tadeo issued the summons following the testimony of Henry Ssejjemba, the Local Council Chairperson of Ssekanyonyi Zone in Mpererwe.
Ssejjemba was testifying as a witness of Businessman Medard Kiconco, who is feuding with residents over Plots 206 and 671 in Sekanyonyi in Mpererwe that he claims to have bought in 2013.
In his testimony, Ssejjemba told court that only 18 people were occupying the contested land when Kiconco bought it. Ssejjemba has been the LC I chairperson of Ssekanyonyi Zone since 1992. He explained that after buying the land, Kiconco compensated 16 squatters, which attracted many more with agreements for the contented land.
Ssejemba claimed that most of the people contested the land in court and nonresidents. As a result, Justice Tadeo summoned Nakibuka to appear with the register of all residents for the last four years.
Court is hearing two consolidated suits filed by businessman Kiconco against the Attorney General and State Minister for Lands, Persis Namuganza seeking compensation for illegally settling people on his land.
He also filed a suit against 148 residents of Sekanyonyi Zone who claims are not Bonafide occupants of the contented land. Trouble started eight months ago, when the Nabweru Chief Magistrate, Rebecca Nasambu granted Kiconco orders to evict the squatters, which saw massive destruction of people’s property.
More than 200 households are believed to have been displaced on the piece of land measuring 9.6 acres. High Court civil Division has since declared the said orders illegal and directed government to compensate the affected occupants.
The case will return to court on July, 29th, 2019 for further hearing
