Mukono, Uganda | THE INDEPENDENT | Mukono High Court Resident Judge, David Matovu has ordered the Mukono district local government to approve Stella Margret Kiondo, as a member of the district service commission representing urban authorities.
Kiondo through her lawyers of Denis Nyombi and Company Advocates asked the court to restrain Mukono District local government and the LCV Chairperson Rev. Peter Bakaluba Mukasa from organizing nominations and elections or appointing any other representative of the urban authority.
The longstanding bickering followed the expiration of the term of service of the District Service Commission on March 12, 2022.
The Ministry of Public Service proposed that Kiondo, who was the former Chairperson of the Service Commission be elected as the representative of the urban council executives.
However, Bakaluba dismissed the proposal citing corruption and bribery allegations filed against Kiondo by job seekers.
Despite the Ministry’s recommendation, Bakaluba insisted on investigations of Kiondo’s background before confirming her as the chairperson.
But Bakaluba instead recommended Dr Godfrey Kibuuka Kisuule as the new chairperson. He also proposed Sarah Katumba, a former midwife, as a member.
However, Justice Matovu found out that Rev. Bakaluba’s allegations against Kiondo lacked any legal justification. He instructed Rev. Bakaluba and the district to approve Kiondo as a member to avoid further delays in recruiting workers.
“An order of certiorari is hereby quashing the Respondents’ decision of rejecting and/ or nullifying the election of the Applicant as the lawfully elected representative of urban councils to the MDSC. An order of mandamus to the Respondents to confirm and forward the Applicant to the Public Service Commission as the duly appointed member representing urban Councils to the MDSC.” Justice Matovu ruled before instructing the respondent to meet all the costs of the case.
This is the third application before the court concerning the Mukono District Service Commission, the first one was filed by Samuel Busulwa, a concerned citizen seeking an order to quash the public service commission decision of rejecting Godfrey Kibuuka Kisuule and Sarah Katumba as the Chairperson and members respectively.
Justice Matovu’s ruling comes a few days after the Mukono District Council passed a resolution to hire the services of the Buikwe District Service Commission to facilitate the recruitment of workers and manage emergencies within the human resources department.
