Kampala, Uganda | THE INDEPENDENT | Justice Lydia Mugambe has deferred the ruling in a case in which Stella Nyanzi is challenging her dismissal from Makerere University.
Justice Mugambe of the High Court Civil Division postponed the ruling to November 8 after failure by Makerere University to produce key documents in relation to the termination of Nyanzi.
Court had ordered Makerere University to produce minutes of the October 23, 2018 Appointments Board meeting which allegedly endorsed Nyanzi’s dismissal.
The university was also expected to produce the Professor David Justin Bakibinga’s report that studied Nyanzi’s employment period at Makerere.
However, Makerere lawyer Hudson Musoke on Wednesday told court that he did not have the documents.
Nyanzi’s lawyer, Isaac Ssemakadde said he was disappointed that Makerere has not honoured court order.
Nyanzi’s appearance in court continues to attract a number of feminist activist groups. As she left court back to Luzira, she met a number of activists holding Uganda flags. They later launched a campaign dubbed “twesibe leesu”, meaning let’s wrap with a Kanga in solidarity with her.
Nyanzi, the embattled research fellow with Makerere Institute for Social Research (MISR) went to High Court challenging her ‘unfair’ dismissal and the university’s failure to pay all her emoluments arising from the illegal suspension.
This was after the Makerere University Staff Appeals Tribunal in November 2018 held that her suspension was illegal and thus ordered for her reinstatement and payment of all her two-year benefits.
She had been indefinitely suspended from the university service, and the tribunal later held that the indefinite suspension was illegal and contravened Sections 63(2) of the Employment Act 2006, which stresses that any such suspension should not exceed four weeks or the duration of the inquiry.
Dr Nyanzi dragged Makerere University to the Civil Division of High Court accusing Makerere University for failing to implement the orders of the tribunal.
During the hearing, Andrew Abunyang, the director human resources directorate of Makerere University had promised court he would table the minutes of the October 23, 2018 meeting of the Appointments Board that decided Nyanzi’s fate.
