Kaweesi Killing: Court gives prosecution ultimatum to conclude investigations

Kampala, Uganda | THE INDEPENDENT | The Nakawa Chief Magistrate’s Court has given prosecution one month’s ultimatum to conclude investigations into the killing of former Police Spokesman, Andrew Felix Kaweesi or Court dismisses the case.

Kaweesi was gunned down together with his driver Godfrey Mambewa and bodyguard, Kenneth Erau on 17th March 2017 at Kulambiro, a Kampala suburb. 19 suspects were picked up in connection to the killings and were charged with three counts of murder and terrorism.

On Tuesday, the matter came up for mentioning before the Nakawa Chief Magistrate, Noah Sajjabi. The state prosecutor, Florence Akello asked Court for more time to conclude investigations into the matter.

However, the defense lawyer, Anthony Wameli asked Court to dismiss the case, saying prosecution has present evidence pinning the 19 suspects. He told court that his clients were tortured while in custody and were locked up beyond the mandatory 48 hours when they should have appeared in Court.

Wameli also told Court that his clients travel long distances to report to the Vourt and incur huges expenses, which is unfair. In his ruling, the Nakawa Chief Magistrate, Noah Sajjabi gave prosecution a month long ultimatum to conclude the investigations or else court throws out the matter.

Speaking outside Court, Wameli, said the charge of terrorism slapped against his clients by linking them to the rebel Allied Democratic Forces is unconstitutional. The suspects are Abdu-Rashid Mbaziira, Aramanzan Noordin Higenyi, Yusuf Mugerwa, Bruhan Balyejjusa, Umar Baganda, Ahamada Senfuka, Hassan Tusiime, Ibrahim Kissa, Osman Mohamed Omarite, Hamidu Magambo.

Others are Abdu Majid, Joshua Kyambadde, Sheikh Musa Ntende, Shafique Kasujja, Abdala Kaala, Sinani Hibwagi, Ali Mugoya, Asuman Mugoya, Swalleh Ddamulira, Sauda Ayub, Yusuf Nyanzi and Jibril Kalyango.
