Kwoyelo bail application hearing set for Tuesday

Kampala, Uganda | THE INDEPENDENT | High Court is set to hear the bail application of former Commander of the rebel Lord’s Resistance Army, Thomas Kwoyelo on Tuesday.

Kwoyelo is seeking his release on bail after spending more than seven years on remand since he was rearrested few minutes after being released by High Court in Gulu in 2011.

The former LRA commander who is locked up in Luzira Maximum Prison is battling charges of war crimes and crimes against humanity before the International Crimes Division of High court.

Rehema Nassuna, the Communications Officer of the International Crimes Division of the High Court, says resumption of the trial was postponed to November 12th in Gulu to give way for the bail application hearing on Tuesday.

According to Nassuna, Kwoyelo will be represented by Dalton Opwonya and Borris Anyuru who were hired on a state brief.

Henry Komakech Kilama, the lawyer for victims admitted to participate in the trial, says they have been notified of the postponement of the trial.

Suzan Alupo, the Program Manager National Peace Documentation Center, which is under Makerere Refugee Law Project, says stakeholders have been informed about the postponement of the trial by the registrar of the International Crimes Division of the high Court Harriet Ssaali in writing.

When contacted for comment, Solomon Muyita, the Senior Communications Officer of the Judiciary, said he was yet to be briefed by the Registrar of the International Crimes Division of the High Court about the changes.

In September, the African Commission on Human and Peoples’ Rights ordered the government of Uganda to compensate Kwoyelo for damages and violations of his rights including delayed trial.

Kwoyelo and the victims of his alleged atrocities have been waiting for justice for more than 10 years since he was arrested from Garamba National Park in the Democratic Republic of Congo.
