Parliament passes NSSF bill, okays mid-term access

Kampala, Uganda | THE INDEPENDENT | Parliament has today considered and passed the National Social Security Fund (Amendment) Bill, 2021. The bill that allows 20% mid term access for workers who have saved for over 10 years and have reached the age of 45, now awaits presidential consent.

“Today, I will breath. I have been getting phone calls and phone calls from the workers of this country. Parliament has delivered on the bill and the workers can now have mid term access of 20% of their savings,” said Speaker Jacob Oulanyah who presided over today’s session.

Earlier,  Parliament reached consensus on which ministry will supervise the operations and activities of the National Social Security Fund (NSSF).

There has been a big contestation on whether the supervisory role of NSSF funds should be under the Ministry of Gender, Labour and Social Development or remain under the Ministry of Finance, Planning and Economic Development under the new NSSF (Amendment) Bill, 2021 which is currently before Parliament.

While debating the report of the Committee on Gender, Labour and Social Development on the bill a day earlier, MPs agreed on the dual supervisory role of NSSF with Gender Ministry taking the lead on supervising social security which includes mobilising and empowering communities to harness their potential while protecting the rights of vulnerable population groups and promoting issues of labour productivity and employment.

Social protection, gender equality rights and equity, human rights, culture and empowerment will be the other core roles.  On the other hand, the role of the Ministry of Finance will only be limited to matters of finance and investments.

The NSSF Bill that was first passed by the 10th Parliament on 17 February 2021, before it was returned to the House by President Yoweri Museveni, seeks to among others allow mid-term access of up to 20 per cent to members who have reached the age of 45 years and above and also seeks to streamline the supervision of the Shs15 trillion NSSF Fund.

The 10th Parliament had voted that the Ministry of Finance retains the supervisory role of the Fund following the President’s rejection of dual supervision saying it was causing delays in decision making.

According to the Minister of Gender, Labour and Social Development, Hon Betty Amongi, this contest has since been harmonised with the two ministries.

“The sticky issue has been the mandate between Ministry of Gender and Ministry of Finance but we have reached a consensus that we the principal act to provide for financial matters to be handled by Ministry of Finance and the rest of the roles shall be by the Ministry of Gender and at an appropriate time, I will move the amendments,” Amongi said.

The Committee Chairperson, Hon Flavia Kabahenda allayed fears that the Fund will still grow even when placed under the Ministry of Gender, urging that indeed it was right to allow social security to be managed by Gender ministry, while Finance ministry handles the financing part.

“The Ministry of Finance is ably represented on the board of directors of NSSF and the entire retirement benefits sector and has a say in how the finances and investments of NSSF are handled. Placing social security under the supervision of the Ministry of Finance would compromise the effective running of the scheme,” Kabahenda said.

Budadiri West MP, Nandala Mafabi tasked the House to streamline the roles of the two ministries in managing NSSF saying for years, there has been back and forth row on which ministry supervises the Fund.

“By saying that this bill will be managed by two ministers, we need to put interpretations clearly stating what each minister is supposed to do. You recall that the Ministry of Finance first took over this Fund because they were looking for money and yet they had no role, he said adding that, ‘we contested and now they are trying to bring out their role. You may also recall that when Rukutana [Mwesigwa] was in Finance, he fought that NSSF is taken to Finance and when he was taken to Gender, he again rushed to grab it back’.

  1. I am 30 years old, Can I get my 20% of my savings since I have saved for over ten years.

  2. I am now 38 years of age and I’ve saved for 16 years now, Kindly consider us also because we also faced the same problems in covid like those of 45years and above. Thanks.

  3. So what about those 45 years plus who are eligible but there birth date from nssf card is different from that one in the national ID card

  4. The proposed ammendment is not equitable in the sense that it does not cater for the burden that is shared across all age groups. I would prefer the longivity of savings being the major parameter. Say 10 years and above. Because someone can be 40 yrs but saved for 10yrs & has been jobless for the last 2 years. So he has to wait for another 3yrs to get his savings?
    And the policy says,upto 20%…meaning one may not get exactly 20% & under what circumstances does this happen?

  7. So you mean,it’s only those 45 and above or those who have saved for 10years that faced financial problems.Please be realistic!..that’s a the smallest fraction of people who need their savings!!.

  8. How long does the president take to sign the bill into law, are we waiting to see it expiring before it’s signed again. Covid killed business and sources of income in general to some of us, and moreover kids are going back to school come January. We humbly request the president to release the law so we can get some money to take our children to school. Thanks

  9. I made 45yrs by 18/08/2021 but I did not know that on my NSSF card it reads that I was born 18/08/1977 yet am of 1976 all my documents bear 1976 but only my NSSF can will it be adjusted during time of claim of my 20% because I have save for more that 15yrs.

I what to take this opportunity to thank the president of Uganda an the parliament for passing and assenting of the law but we who a not yet 45 year and we have sarved for more than 10year and we have more than 20 millions(twenty millions) how can nssf help us because we a also going through so many hardships please…….
