Kampala, Uganda | GODFREY SSALI | The General Court Martial has refused to grant bail to SSP Nixon Agasirwe Karuhanga, the former commandant of the police’s special operations unit, who is charged with kidnap of three Rwandan nationals.
The seven-member court chaired by Lt.Gen Andrew Gutti today dismissed Agasirwe’s bail application on grounds that he presented no substantial sureties who would ensure his return to court for trial.
The Court has also ruled that Agasirwe being a senior police officer at the rank of Senior Superintendent, he is likely to interfere with investigations and threaten state witnesses.
This is the second time the army court is declining to release a senior police officer on bail.
The first being Agasirwe’s co-accused ASP Joel Aguma whose bail application was thrown out and advised to await trial.
Agasirwe and Aguma’s only hope are now left in the applications they filed in the High court Civil Division challenging their trial, before the Army court.a
The two officers are on remand at Luzira Prison and Makindye military police barracks respectively, for kidnap of three Rwandan nationals whom they allegedly conveyed to their country against their will in 2013.
Agasirwe is accused of kidnapping a one Lt. Joel Mutabazia former body guard to President Paul Kagame before sending him back to Rwanda.
He is accused together with Agum,a Commandant of Professional Standard Unit, former commander of Police Special Operations, Sargent Abel Tumukunde of the Flying Squad, Assistant Superintendent of Police Magada of Crime Intelligence and Faisal Katende of the Flying Squad.
They have since denied the allegations levied against them by CMI.
