Kampala, Uganda | THE INDEPENDENT | Tororo Cement Limited has dragged businessman Ali Kakooza to court seeking to recover more than one billion Shillings for various goods and materials supplied to him.
In their suit before the Commercial Division of High Court, Tororo Cement contends that between January and December 2019, they supplied various goods that include cement and building materials to Kakooza who trades as United Star Enterprises.
Through its lawyers of Kajeke, Maguru and Company Advocates, Tororo Cement notes that Kakooza had earlier mortgaged to them his land located on plot 15 in Busiro as security for the goods to be advanced to him.
The company alleges that Kakooza paid some money which is not disclosed and also remained with a balance of one billion and 72 million shillings which he has since refused to pay. They further contend that they have requested him to pay several times but in vain hence dragging him to court.
The application is supported by the affidavit of Krishnendu Banerjee the senior sales and marketing manager at Tororo Cement who says that the actions of Kakooza breached the agreement.
Kakooza has since been given ten days by the Commercial Court Registrar to file his defence in the matter within 10 days before a hearing date can be given.
“You are hereby required within 10 days from the service hereof to apply for leave from the court to appear and defend. Should you fail within the said period of 10 days to apply for such leave, the plaintiff will be entitled to obtain a decree for an amount or the right claimed in the plaint together with the sum of Uganda Shillings as costs”, reads the summons in part.
